A man will appear in court next month after allegedly assaulting a police officer at a restaurant in Cronulla on Sunday night.

Shortly before 1am today two police officers from Miranda Local Area Command were conducting patrols of business premises as part of their licensing duties.

As the police walked past a patron in the Cronulla Street restaurant the 36-year-old man allegedly made a comment to one of the officers.

The man was asked to leave the premises numerous times by the officers but refused and became aggressive.

After he allegedly pushed one of the officers he was arrested and a struggle ensued.

An officer was head butted to the face but the man was eventually removed from the club with the assistance of security officers.

The brawl continued outside the club and officers utilised OC spray when a second man intervened.

Both men were eventually arrested and decontaminated from the OC spray.

As the 36-year-old man was escorted to the police truck he kicked the same police officer in the chest.

At Miranda Police Station the man was charged with fail to quit licensed premises, assault police, resist police, hinder police and offensive language.

The Sylvania man has been bailed to appear at Sutherland Local Court on 11 October.

The second man, 27, has been released pending further inquiries.

The injured officer was treated at Miranda Police Station for a small laceration to his mouth.

Police inquiries into the incident continue.
